1. GENERAL INFORMATION.
In accordance with the provisions of Law 34/2002, of 11 July, on Services of the Information Society and Electronic Commerce, we hereby inform that the owner of the website www.resa.es is RESIDENCIAS DE ESTUDIANTES, S.A. (hereinafter, RESA) with address at C/ Roger de Llúria nº118, 1º, 08037 Barcelona, Spain, with Tax Identification No. A-60.109.188, inscribed in the Trade Registry of Barcelona, Volume 24,281, Folio 95, Page No. B-67.261, Inscription 1.
The text that follows serves the purpose of regulating the use by Internet users of the Website owned by RESIDENCIAS DE ESTUDIANTES (RESA). The function of the present Legal warning is that of establishing the conditions that regulate the access and general use of this Website for all users, so that that access to and use made of this site will necessarily entail the submission to and acceptance of the present general conditions, as well as, in the event of the contracting of an accommodation booking service, the General Conditions characterising this contracting (hereinafter General Clauses).
Some of the services of the Website that are accessible for Internet users or exclusive for RESA customers may be subject to particular conditions, norms of use and instructions that, if applicable, serve as a substitution, completion and/or modification for the present Legal Warning and which will have to be accepted by the User before the corresponding service is made.
Please read this Legal Warning carefully every time you visit this Website, which may be modified at any moment and which the User will be able to print for the record. Should you not agree with the conditions stipulated, we must ask you not to use this Website.
2. INFORMATION ON THE OWNERSHIP OF THE RESIDENCE HALLS.
RESA is a society offering real estate services and specialising in the design, conception and management of residence halls for students all over Spain, with a current approximate total of 5, 200 beds. RESA has constituted different holding companies, which are the owners of the administrative franchises or of the land rights over the residence halls, are each known as a SIRESA, or alternatively Sociedad Inversora en Residencias para Estudiantes (Company Investing in Residence Halls), plus a word related to the University, city or region where residence hall is located. The owner companies of each residence hall are those listed in the following table:

Each owner society of the residence hall or halls, (hereinafter, SIRESA) has entrusted RESA, the society with material and human resources, with the operation of its residence hall by means of a lease contract for the administration and management of urban properties subscribed by the parties involved.
Thus, each SIRESA, the owner of one or several residence halls, subscribes an accommodation contract with each resident student and/or customer who books accommodation in its residence hall for a period of more than three months.
By virtue of the provisions of Law 7/1998, of 13 April, on General Contracting Conditions and of the aforementioned Accommodation Contract containing a series of general conditions, which are common and are incorporated onto several contracts, each SIRESA has inscribed these General Conditions of contracting in the Registry of Movable Goods of Barcelona.
This Website has been created and is managed by RESA, which is also in charge of the management and operation of each one of the residence halls for students owned by the SIRESA entities.
3. GENERAL TERMS AND CONDITIONS FOR BOOKING AND CONTRACTING.
Access to this Website is open and free of charge. It will thus be understood that, upon access to and/or use of this Website, the Customer/resident is to acquire the condition of a User (hereinafter, the User), which entails his/her adhesion to the present Legal Warning.
The function of the present Website is that of providing those users gaining access thereto with the different services offered by RESA via this very same Website. The purpose of the present Conditions is that of regulating the general conditions of the place booking and contracting services via the present website, which is owned by RESA.
Both the accommodation booking service in any of RESA’s residence halls and any other service managed by the aforementioned entity via this Website are regulated by the present Conditions of use the legal warning is composed of and completed by.
The use of these services will entail the full and unconditional acceptance of each and every one of the General Contracting Conditions included in the last updated version of the General Conditions.
RESA hereby informs that the steps to be taken for obtaining the services offered are those described in the present booking and Contracting General Conditions, as well as other specific services indicated onscreen during navigation, meaning that you declare both knowledge and acceptance of these procedures as necessary for contracting the services offered in this Website.
RESA reserves the right to unilaterally modify any of the points included in the present General Conditions without prior warning and in such a way as is deemed convenient, the users being informed of the modifications carried out via the Website, in order for these modifications to be exposed and be newly accepted by the Users.
In the event of any of the stipulations contained in the present General Conditions for booking being declared null and void, the rest of General Conditions will remain within the terms agreed upon.
3.1. Use of the academic year accommodation service.
The User interested in finding accommodation at any of our residence halls will have to fill in an application form to book a lace at the residence hall in question with his/her personal data. The purpose of this service is that of booking a room for a specific period at one of our residence halls.
The User accessing this service will have to be of legal age in accordance with Spanish legislation, and have the legal capacity needed or hiring the services offered in the present Website on his/her own accord. In the event of a minor hiring these services, the minor’s parents or tutors will be required to give their authorisation for him/her to be able to hire the service.
On a general basis, the personal data supplied to us will be used for a correct management of the place booking, as well as for the subsequent contracting with the Customer/User (see point 3.2 “Use of the hiring service”). Consent for the conveyance of personal data will be revocable at any time although this will not have retroactive effects.
The data provided by the User will be used in order to attend to your booking application and for adapting the products and services requested by the User to the preferences indicated in the place booking Form (data registration) and this will entail the use of your electronic mail address for you to be able to receive mail from RESA. Prior to filling in the Form and supplying his/her data, the User will be informed of the Advance Registration Conditions, which he/she may choose to accept or reject. The system does not permit any access to the place application form corresponding to the residence hall chosen (known as Advance registration form) without a previous reading of all the conditions and their voluntary acceptance.
Once the advance registration form has been filled in, the User will be sent an electronic mail bearing all of the data he/she has entered in the Form, as well as a validation link for confirming his/her agreement with them. When the user presses on the validation link, his/her application will be automatically registered in the database.
Upon accepting the confirmation of the booking form, the User will have a user identification name as well as a personal, non-transferable password designated by RESA via e-mail, in order to ensure the identification of each Customer/User and the confidentiality of the operations carried out; with these confidential data (user and password), it will be possible to access one’s private area in the Website.
RESA accepts no responsibility for whatever misuse of the password is made by the User as a registered customer when booking or hiring services at the RESA Website. The User will be liable at any time for the custody of his/her password, thus accepting any damages that may derive from its misuse, as well as from its cession, revelation or loss. In the vent of the password being forgotten by the User or of any other circumstance entailing risk of access and/or use by unauthorised third parties, the User will immediately give notice of this to RESA, so that the alter may proceed to blocking and replacing the password. In any case, any operation put into effect prior to giving notice of such an event will be reputed as having been carried out by the User, who will be liable for the damages resulting from any unauthorised access and/or use that may occur prior to the notice being given.
3.2. Use of the online booking service for daily accommodations at the Campus del Mar residence hall.
3.2.1. The User/Customer will fill in a form with his data for this type of bookings at the Campus del Mar residence hall, the form including a verification box with the general contracting conditions of the booking, so that the Customer can give his acceptance if he/she agrees.
Once the User has filled in all of his/her data in the form, his/her booking will be immediately confirmed via an electronic mail, and he/she will be assigned a confirmation number of the formalised booking. This mail will serve as a voucher of his/her booking and as a conformation of acceptance.
3.2.2. Cancellation policy:
Those bookings made via the present Website will be guaranteed by means of the credit card supplied by the User in the form. The booking may be cancelled free of charge until 24 hours before the day of entering the residence hall.
A failure to appear at the check-in or a cancellation beyond the term agreed upon in the offer will entail an automatic charge to the credit card at the amount stipulated in the offer of the Campus del mar residence hall, as well as the immediate cancellation of the booking and the penalty of one night per room.
In order to cancel an online booking, you may contact the booking department, which will give you customised attention service via the telephone number (+034) 93 390 40 00 of the Campus del Mar residence hall during Reception hours from Monday to Friday from 7.30 a.m. to 11 p.m., and on Saturdays, Sundays and holidays from 8 a.m. to 8 p.m., or via the electronic mail address campusdelmar@resa.es.
Check-in hours are until 2 p.m., while checkout hours are until 11 a.m.
The User must use this service in accordance with the Law, with morality, good conduct and public order, as well as the provisions of the present General Conditions regarding online booking. Consequently, he/she is compelled not to use these services for illicit purposes or for purposes contrary to the present General Conditions, contrary to Law, and/or harmful to the interests of third parties or otherwise damaging to the services and/or image of RESA.
3.2.3. Prices per room and night are inclusive of V.A.T, and correspond to those given in the present Website, more specifically in the residence halls that expressly offer this service.
4. USE OF THE CONTRACTING SERVICES. GENERAL CONDITIONS.
Once the User/Customer has gained access to the private zone (known as users zone) of the RESA Website with his/her personal and non-transferable personal codes (user and password), he/she will be able to refer to a section listing the General Clauses (known as General Conditions) for the contracting of accommodation at the residence hall chosen and be likewise able to download and print the rest of contractual documents.
These General Clauses will have to be accepted (by means of the validation box) by the Customer so that the online contracting may be considered to be effectively formalised. Once the user has accepted the online contract, he/she will automatically receive an electronic mail confirming that he/she has been accepted.
All the General Conditions for contracting at each one of the residence halls managed by RESA are registered in the Personal Property Registry of Barcelona, in the General Conditions Deposit Book.
In the event of one of the stipulations of the General Contracting Conditionings being null and void, the rest of General Conditions will remain in force.
5. INDUSTRIAL AND INTELLECTUAL PROPERTY.
All the contents of this Website, including its texts, photographs, images, and other audiovisual contents, as well as the graphic design, and its contents in general constitute the intellectual property of RESA or, if applicable, of third parties, if any.
Likewise, the brands or distinguishing marks constitute the exclusive ownership of RESA or of third parties, in which case this will be specifically expressed. The User, at every moment, will have to respect the rights of intellectual and industrial property of the Website, which is the ownership of RESA.
The reproduction, copying, public communication, distribution, transformation or modification of the elements of the Website for commercial or professional purposes, or the infringement of any other right liable to protection by the Law of Intellectual Property or Industrial Property are strictly prohibited unless carried out with the authorisation of the owner of the corresponding rights or if the action in question is legally permitted.
RESA authorises the Users to use, print and download the context inserted in the Website and which they consider to be necessary exclusively for personal, private, non-profit use, as long as it is not used with the purpose of carrying out commercial or professional activities, or for their distribution, modification, alteration or decompiling, or in such a way as to incur in distortion of the results intended by the owner of the website.
An infringement of any of the aforementioned rights may constitute a violation of the present provisions, as well as a punishable offence punishable in accordance with articles 270 ff of the Penal Code or any other general provisions dictated for that purpose.
6. DOMAIN NAME.
The domain name or address of the present legal Website www.resa.es is the property of the holder of the page, as is recorded in the trade registry of Barcelona. Its holdership is exclusive and its use by third parties constitutes a violation of the rights conferred and granted by the aforementioned registration of this domain name to its holder.
7. CANCELLATION POLICY.
By virtue of the provisions in Royal Decree 1906/1999, of 17 December, regulating electronic contracting with general conditions, in development of article 5.3 of Law 7/1998, of 13 April on General Conditions of contracting, the User must be informed that he/she has contracted the accommodation booking of one of the residence halls of the present Website and has electronically accepted the General Clauses of the contracting (General Conditions), that he/she will be able to cancel the contract via electronic mail of the address of the residence hall within a term of seven working days, starting after the date of receipt of the confirmation of the formalised accommodation contract and which will, in turn by sent by electronic mail, without incurring in any type of penalty.
8. APPLICABLE LAW AND COMPETENT JURISDICTION.
The User recognises and expressly agrees that the present Legal Warning represents the entirety of the agreements between him/her and RESA and/or the SIRESA, whether they be verbal or written in relation to its purpose. This Legal Warning replaces and substitutes any other proposals, correspondence, commitments or other communications between the User and RESA in relation to the Legal Warning and the conditions of use.
Any other litigious matter that may result from the access to the Website owned by RESA and from the relations with the customers resulting from the offering of the services included in the Website, should be referred to the Spanish legislation, the Courts and Tribunals of the city of Barcelona (Spain) being competent for their resolution, with express waiver of any other general or special jurisdiction that may correspond to any of the parties.
